Grounds to Qualify for Asylum
You may qualify for asylum if you have been persecuted in your home country based on your:
- Race
- Religion
- Nationality
- Political Opinion
- Membership in a particular social group
The Asylum Process and Additional Requirements
You must apply for asylum within one year of entering the United States. Currently, there is no fee to apply for asylum.
However, most people who make an application for asylum do so as a tourist, go through the interview process and are then denied. Your case will then be referred to the immigration courts. Having an attorney by your side from the beginning can increase your chances of a successful petition because they know how the immigration offices work and how to prepare for the court procedures.
If you are eligible for asylum you may be permitted to remain in the United States, and I can help work with you to extend your eligibility to remain in the country while your application is under review. You are also eligible for employment authorization after your asylum case has been pending for 150 days.
If you are granted asylum you may work immediately. You may also then make an application to bring over your spouse or children on the same grounds you applied for asylum. The children must be unmarried and under 21 to be considered. These additional applications must be made within two years of being granted asylum unless there are humanitarian reasons to excuse this deadline.
