Some people come into the country as immigrants, usually through a non-immigrant tourist visa, because they wanted to escape the persecution and violence of their home country. Other people come to the country without any authorization for the same reasons. I can help you if you are in either situation.
Seeking Asylum? Affirmative Asylum Petitions and Defensive Asylum Petitions
In my legal practice, I can offer two types of asylum services, depending on the situation our clients are in:
- Affirmative asylum petition: This is when someone comes into the country as an immigrant and does not want to return home because of the threat of violence there. Sometimes visitors experience religious conversion or something of that nature and they know that they will be persecuted for their new beliefs when they return to their native countries. I can often help get the asylum process started before our clients overstay their visas.
- Defensive asylum petition: This is for clients who are already in deportation proceedings. Perhaps you came into the country illegally in the first place and are now seeking political asylum or religious asylum, overstayed your visa or committed one of the crimes that render you deportable. Whatever the reason you are facing deportation, if there is a good probability that you are going to be persecuted in your home country, I can petition for asylum.
Regardless of whether you are already facing deportation or not, the most important thing needed in the asylum process is display convincingly to the immigration judge that you have a well-founded fear of persecution in your home country.
